Ballot Language Lawsuit
Ruling Update: On August 3, 2026, Leon County Circuit Judge David Frank ruled that the ballot title and summary for Amendment 3 were “clearly and conclusively defective.”
Judge Frank found that the original ballot language did not adequately explain the amendment’s legal purpose and instead appeared to advocate for its passage while obscuring its actual effects.
The order prohibits Secretary of State Cord Byrd from placing the current language on the November General Election ballot. and directs Attorney General James Uthmeier to submit revised ballot language within 10 days that objectively describes the amendment and its impact, rather than using language that could be interpreted as campaign advocacy.
Next Step: Once a revised version is submitted to the Department of State, any challenge to the revised language must be filed within 10 days. the Court has retained jurisdiction to review those challenges.
While the litigation over the ballot language may continue, the proposed constitutional amendment itself remains on the November ballot.
Voters are encouraged to review the updated ballot summary, once released, along with other official resources to better understand the amendment’s potential effects on property taxes, local government funding and impacts on their community.
